About the privacy policy

M HKA vzw, having its registered office at Leuvenstraat 32, 2000 Antwerp attaches great importance to the protection of your privacy and personal data. That is why in this privacy policy we want to explain to you, in the most transparent way, what personal information we can collect concerning your person, why we want to collect it, how we want to use it, and how we want to process it.

The current Privacy statement relates to all personal information that is collected and processed by M HKA, CKV and Cinema Zuid. The latter falls under the management of M HKA. In this Privacy statement, M HKA explains what data relating to you is collected, what it wants to use this data for and to whom it transfers this data. M HKA can change the privacy policy at any time by, for example, making legal changes in the privacy policy (external), but also by making changes in the museum services (internal).

What does this privacy policy apply to?

This privacy policy applies to all services of M HKA, CKV and Cinema Zuid, hereinafter referred to as M HKA for short.

‘All services’ of M HKA shall be understood to mean:

  • the M HKA services that you come into contact with when you visit M HKA, media campaigns, public events organised by M HKA, as well as administrative services (applications, invoicing, etc.).
  • all online services of M HKA, i.e. the website, apps, internet services offered by M HKA and access to content (e.g. press site for journalists, digital platforms, ensembles.org, etc.).

Personal data collected by M HKA

From whom do we collect data?

M HKA collects and processes personal data of natural persons with whom M HKA has or had a direct or indirect relationship or wants to have one in the future.

Collecting and processing data

‘Processing of data’ refers to ‘any processing of personal data’ for M HKA. Processing refers to collecting, recording, organising, saving, updating, changing, requesting, consulting, using, disseminating or making available in any way, grouping, combining, archiving, deleting or destroying. M HKA must always have the (museum) visitor’s legally required consent to process the personal data. On the one hand, the data is saved on a secure server of M HKA and on the other hand at physical locations. M HKA has a procedure which comes into force in case of (a) possible data leak(s).

How does M HKA collect the data?

Personal data provided by you

To be able to use certain museum services, you will provide personal details to M HKA, such as an e-mail address, name, date of birth, address and town/city. Additional information may be requested, such as your interests, to help M HKA provide more personalised services.

Your data is also saved when you contact M HKA by phone, mail, public WI-FI, a physical visit to the museum, etc.

Personal data that M HKA collects following your use of the M HKA online services

These are:

Log file data, such as an IP-address, opened pages, mouse clicks, the date and time of your visit, your browser, etc. This data allows the visitor to be recognised and can tell M HKA how the visitor uses the museum services. (e.g. which exhibitions you clicked on, which events interest you, did you only click or did you also read everything?, how did you get to the website?, etc.)

Device data, such as an IP-address, brand, type and operating system of your device. If relevant, M HKA may also get a rough indication of your location.

M HKA uses cookies and Google Analytics

Cookies

The M HKA websites use cookies to ensure that users can experience all functionalities of the website and to measure visitor behaviour. These cookies are not used to follow your browsing behaviour on other websites. Furthermore, these cookies are necessary for the efficient operation of the website. If you don’t want to use cookies, you can avoid this by changing the settings in your internet browser. Consult the help function for this.

Google Analytics

Our website installs a cookie of US company Google, as part of the “Analytics” service. M HKA uses this service to keep track of, and obtain reports on, how visitors use our website. Google can provide this information to third parties if Google is required to do so by law, or to the extent that these third parties process the information on Google’s behalf. M HKA cannot influence this. M HKA has not given Google permission to use the obtained analytics information for other Google services.

Personal data supplied by third parties

If you use social network functions on our online services, you give your consent to the social network site to share certain clearly specified data with M HKA. Usually this concerns standard data such as name, address, postal code, date of birth, etc. M HKA can add this to the already existing data.

It may also concern certain data relating to the museum visitor’s behaviour on the social network site, such as ‘likes’ for example. M HKA can only use the data which the visitor shares himself/herself and in so far as the personal settings allow this. If the museum visitor does not want this, he/she must change the settings on the social network sites.

M HKA can also collect information from other reliable sources, for example following a collaboration with a media partner, both online and offline. M HKA shall only collect this information if the data was collected by the third party legitimately and if this party also legitimately shares it with M HKA.

Why does M HKA collect data?

M HKA collects personal data for the following purposes:

Service and maintaining the relationship with the museum visitor

M HKA collects data to be able to provide the requested services:

  • inform about exhibitions, museum activities, children’s workshops, artist talks, openings, press showings, performances, general promotion, new publications, etc.
  • invitations to exhibitions and all kinds of activities connected to M HKA

Direct marketing

Subject to your approval, M HKA collects your data with a view to sending newsletters and invitations regarding activities or news regarding M HKA.

Financial administration

M HKA processes personal data to be able to correctly carry out the accounts and administration of M HKA.

Hiring purposes

M HKA collects personal data with a view to hiring new staff members. This is done in mutual consultation.

Security

When a museum visitor visits M HKA it is recorded. These records are to ensure the security of both museums. It is a legitimate interest to process this data in the context of the security of our infrastructure, staff members and visitors.

Sharing data

M HKA shall not transfer or sell personal data to third parties.

Suppliers

M HKA works with a number of independent service providers, among others for the provision of a number of infrastructure or IT services, making payment transactions, etc. It is therefore possible that these companies, in the context of the commission awarded by M HKA, have access to certain data and information. M HKA only allows this to the extent that it is necessary for the execution of their commission and that these companies offer the necessary guarantees relating to the access and the possible use of this data and information.

Social media

Some M HKA online services have social media buttons of social network platforms such as Instagram, Twitter and Facebook. This allows the museum visitor to share information. These buttons are not managed by M HKA, but by the social networks. This means that M HKA has no control over what these companies do with this data and that the M HKA privacy policy does not apply here. Every social network has its own privacy policy that the museum visitor can consult.

Authorities

M HKA may be obliged to share or transfer personal data with or to the authorities. For example, this may concern a judicial inquiry or decision, to detect and solve fraud or security problems, to comply with the law or to protect the rights of M HKA.

Security of the data

M HKA has taken the necessary steps to keep both the digital and the physically saved personal data secure, correct and up-to-date.

Storage time of the data

The personal data is not saved any longer than necessary for the exercise of the M HKA activities and the provision of our services. A legal obligation may oblige M HKA to save your personal data longer.

What are the rights of the visitor and how can they be exercised?

Right of access to personal data

M HKA offers all visitors the possibility to access their personal data.

The visitor has a right to an answer to the following questions:

  • Does M HKA process my personal data?
  • What are the personal data processed for?
  • What categories of personal data are there?
  • With which categories of third parties does M HKA share the personal data?
  • What is the origin of the processed data?
  • Why does M HKA process certain personal data automatically?

Edit/unsubscribe newsletter service

At the bottom of every mailing the visitor will find the possibility to edit his/her data or to unsubscribe.

Right to object against the processing of your data for direct marketing

At any time, the museum visitor has the right to object to the processing of his/her data for direct marketing purposes.

Right to rectification and erasure

Incorrect, obsolete or inappropriate personal data can always be adapted or removed on request.

Right to be forgotten

The visitor has the right, at any time, to obtain the right of erasure of his/her personal data from the M HKA databases.
